What the MRTA is

The Marijuana Regulation and Taxation Act, usually shortened to MRTA, is the law that made adult-use cannabis legal in New York. Governor Cuomo signed it on March 31, 2021. It legalized possession and use for adults 21 and over, set up a licensed retail market, and created the agency that runs the whole system. Personal possession rules took effect right away when the law was signed.

Why it matters when you shop

The MRTA is the reason a licensed store like The Highline can legally sell to you at all. It set the 21+ age floor, defined how much cannabis an adult can carry, and created the framework for testing, labeling, and packaging. Every legal product you see on the menu exists because of the rules this law put in motion. Effects may vary. Please consume responsibly.

What does the MRTA allow adults to possess in New York?

Under the MRTA, adults 21 and over may possess up to three ounces of cannabis flower and up to 24 grams of concentrated cannabis (such as vape oil or edibles) outside the home. The law also allows storing up to five pounds at home in a secure place. Always confirm current OCM rules.

What the MRTA created

  • ·The Office of Cannabis Management (OCM), governed by the Cannabis Control Board, to regulate adult-use, medical, and hemp cannabis
  • ·A licensed retail market with a goal of awarding half of adult-use licenses to social and economic equity applicants
  • ·Automatic expungement of many past marijuana convictions
  • ·Home cultivation rights for adults, which phased in after retail sales began

Practical takeaway

You do not need to memorize the statute. Just remember the basics: 21+ only, buy from a licensed dispensary, and stay within the possession limits when you carry product. Look for the New York universal symbol and the OCM license on any store you visit. That is how you know a shop operates under the MRTA and not the legacy market.
