Adult-Use Cannabis

Adult-use cannabis is legal, non-medical cannabis that adults 21 and older can buy from licensed New York dispensaries without a doctor or medical card. It was legalized by the Marihuana Regulation and Taxation Act in 2021 and is regulated by the Office of Cannabis Management.

Adult-use cannabis is the legal name New York uses for non-medical cannabis, the kind most people call recreational. How New York set it up

New York legalized adult-use cannabis through the Marihuana Regulation and Taxation Act, known as the MRTA, signed into law on March 31, 2021. The same law created the Office of Cannabis Management (OCM), which is governed by the Cannabis Control Board. OCM handles licensing, lab testing rules, packaging standards, and enforcement for adult-use, medical, and hemp cannabis across the state.

Under New York law, adults 21 and older may possess up to three ounces of cannabis and up to 24 grams of concentrated cannabis, such as oil or edibles, outside the home. Limits for storage at home and home cultivation differ. Always check current OCM rules, since regulations can change.
