Short version. In New York, adults 21 and older can consume cannabis in a private home or in most places where smoking tobacco is allowed. That is the rule that surprises people. New York is one of the few states that ties cannabis consumption to its tobacco smoking rules instead of banning it from all public space. But the exceptions matter, and a few of them are easy to trip over right here in the Rivertowns.
If you can legally smoke a cigarette on a given sidewalk, you can generally consume cannabis there too. The flip side is just as important. Anywhere tobacco smoking is banned, cannabis is banned the same way. New York's Marihuana Regulation and Taxation Act (the MRTA) made adult use legal in 2021, and the state's Clean Indoor Air Act, the same law that governs cigarettes, was updated to treat smoking cannabis like smoking tobacco.
Can you legally smoke cannabis in public in New York?
In most places where smoking tobacco is legal, yes, for adults 21 and older. New York ties cannabis consumption to its tobacco rules. The big exceptions are motor vehicles, parks and beaches, federal property, and any private business or indoor space where smoking is already banned.
Where you cannot consume, no exceptions
These are the lines the Office of Cannabis Management draws clearly. They apply whether you smoke or vape, and in some cases regardless of method.
- Motor vehicles. You cannot consume in a car, moving or parked, as a driver or a passenger.
- Federal property. National parks, federal buildings, and federal housing are off limits, because cannabis is still illegal under federal law.
- New York State parks, public parks, and beaches.
- Private businesses. A restaurant patio, a hookah or cigar bar, a shop, or a hotel that bans smoking can all say no.
- Anywhere tobacco smoking is already prohibited, including within 100 feet of school grounds.
The Rivertowns angle
A few local specifics if you live in or visit Hastings-on-Hudson. The Old Croton Aqueduct trail that runs through town is a New York State Historic Park, which puts it under the state park rules, so consuming there is not allowed. The same idea applies to the Hudson waterfront parks and Draper Park as managed public park land. The Metro-North Hudson Line train and its platforms fall under public transit and smoke-free rules. The safest place to consume is a private home where the property owner allows it.
Can you consume cannabis in your apartment in New York?
Generally yes in a private residence, but your landlord can prohibit smoking and vaping cannabis on the premises. The state legalizing use does not override a no-smoking lease clause. Non-combustible options like edibles or tinctures sidestep the smoke restriction entirely.
Driving is the one to take seriously
Driving under the influence of cannabis is illegal in New York, and the penalties mirror alcohol. There is no roadside number that clears you the way a breathalyzer does for alcohol, so any impairment an officer observes can lead to a charge. Plan a ride.
