Cannabis is legal for adults 21 and older in New York. The short version: you can carry up to 3 ounces of flower or 24 grams of concentrate on you, buy from a licensed shop with a valid photo ID, and consume in most places where tobacco smoking is allowed. The longer version has a few rules worth knowing before you shop, especially here in the Rivertowns.
This guide covers the basics every adult in Hastings-on-Hudson, Dobbs Ferry, Irvington, and northern Yonkers should have straight: who can buy, how much you can hold, where you can use it, and what home grow looks like. None of this is legal advice. For the official rules, the New York Office of Cannabis Management posts everything at cannabis.ny.gov.
Who made these rules
New York legalized adult-use cannabis on March 31, 2021, when the Marihuana Regulation and Taxation Act (the MRTA) was signed into law. The MRTA created the Office of Cannabis Management (OCM) and the Cannabis Control Board, which together write the regulations and issue retail licenses. The Highline holds one of those licenses, OCM-RETL-2025-000417, posted in the shop and verifiable through OCM.
How old do you have to be, and what do you need to buy
You must be 21 or older to buy, possess, or use adult-use cannabis in New York. That is a hard line, with no exceptions for adult-use products. To buy at a licensed dispensary, bring a valid, government-issued photo ID. We check it at the door and again at the register every time, no matter your age. If you order delivery, the driver checks ID at handoff too.
Do I need to be a New York resident to buy cannabis in New York?
No. Any adult 21 or older with a valid government-issued photo ID can legally buy at a licensed New York dispensary, including visitors from other states. You cannot legally carry cannabis across state lines, so plan to use or finish what you buy within New York.
How much can you carry
On your person, New York lets adults 21 and over possess up to 3 ounces of cannabis flower or up to 24 grams of concentrate, which includes products like vape oil and edibles measured by their concentrate content. That is a generous amount for personal use. For context, most people walk out of the shop with far less.
Where can you legally consume it
The general rule is simple: you can use cannabis in most places where smoking tobacco is allowed, under New York's Smoke-Free Air Act. A private home is the most straightforward option. Beyond that, the rules narrow quickly, and a few spots are clearly off-limits.
- No consuming in a motor vehicle, even when it is parked. Driving while impaired carries penalties on par with an alcohol DWI.
- No smoking or vaping on federal property, which includes federal buildings and many parks and lands.
- No use in or near schools, or in places already covered by smoking bans like indoor workplaces and many outdoor public spaces.
- Local parks, the Hudson waterfront, the Old Croton Aqueduct trail, and Draper Park follow public-space smoking rules, so treat them as no-go for lighting up.
Can I smoke cannabis while walking along the Old Croton Aqueduct or the Hudson waterfront in Hastings?
Treat public parks, trails, and waterfront spaces as off-limits. New York's Smoke-Free Air Act restricts smoking in many outdoor public areas, and federal or local rules can apply. The safest, clearly legal place to consume is a private residence where the owner allows it.
Can you grow your own
Yes, within limits. Home cultivation became legal for adults 21 and over when the Cannabis Control Board adopted the rules in mid-2024. Each adult may grow up to six plants at home, three mature and three immature, with a household cap of twelve plants total, six mature and six immature, no matter how many adults live there. Plants must be kept secure and out of reach of anyone under 21.
One important catch: it is illegal to sell, trade, or barter homegrown cannabis. Growing for yourself is fine. Turning it into a side business is not. Selling cannabis legally requires a state license.
How to tell a legal shop from an unlicensed one
New York has worked to shut down unlicensed sellers, and buying from them is a real risk: untested products, no recourse, and no guarantee of what is inside. A licensed dispensary posts its OCM license, checks ID, sells lab-tested products with a certificate of analysis available, and shows up on the state's verified retailer list. If a shop does not check your ID or cannot show a license, walk out.
If a shop does not check your ID or cannot show its OCM license, that is your sign to walk out.
Is cannabis delivery legal in New York?
Yes. Licensed New York dispensaries can deliver to adults 21 and over, with ID verified at handoff. The Highline offers same-day delivery to Hastings-on-Hudson, Dobbs Ferry, Irvington, and northern Yonkers. Delivery follows the same possession and age rules as buying in the shop.
That is the framework in plain terms: 21 and up, photo ID, sensible possession limits, consume in private, grow a little if you want, and buy from a licensed shop. If you want to put it into practice, browse our real menu of roughly 40 craft cultivars from independent upstate growers at /order, or stop by 45 Main Street and ask a budtender. We are happy to walk you through any of it.
